Terms and Conditions of Use

1. Acceptance

By creating an account or using KURVO (the kurvo.es website and the mobile app, “the Platform”), owned by Sergio Navarro Navarro y Luis Rodríguez Céspedes, you accept these Terms, the Privacy Policy and the Cookie Policy. You are asked to accept them in the app, and your acceptance is recorded with its date and version. You must be at least 14 years old (15 if you live in France).

2. The service

KURVO lets you organise rides for any activity (motorcycling, cycling, walking, running…), share your location with the group during the ride, choose guardians who look out for you and receive your alerts, send safety alerts (SOS, breakdown, fall), record and publish tracks, chat and take part in challenges. The service is provided “as is”; it is still evolving and some features may change or be interrupted.

3. Road safety — read this

  • Do not handle your phone while riding or driving. Set up the ride before you set off. The alerts are designed to be used when you have stopped or by a companion.
  • KURVO does not organise races or speed competitions. You alone are responsible for complying with traffic rules and speed limits.
  • SOS, breakdown and fall alerts, and the SMS and calls to your guardians, are help between people and do not replace the emergency services (112). Their delivery depends on network coverage, the device, third parties (carriers, SMS and voice providers) and your guardians being available, and it is not guaranteed. In an emergency, call 112.
  • Automatic fall and stop detection is only indicative: it may fail to detect a real fall and it may raise an alert when there has been none. You can cancel an alert with “I'm OK”.

4. Guardians

A guardian is a person with a KURVO account whom you choose and who agrees to be one. By agreeing to be someone's guardian, you agree that, when that person sends an SOS or we detect a fall, you will receive their position by notification, by SMS and, if nobody responds within about 30 seconds, by phone call; for this purpose, your phone number is shared with our SMS and voice provider. You can stop being a guardian at any time from Settings → Your people. Being a guardian does not legally oblige you to act, but KURVO relies on the people who accept really meaning it: do not accept if you are not going to be available.

5. Your account and your content

You are responsible for the accuracy of your data, for keeping your credentials safe and for what you publish. The tracks, photos, texts and other content you generate are yours; you grant us the non-exclusive licence strictly necessary to store, process and display them to whoever you decide (your group, your guardians, your followers, anyone with a link you share) while the content is on the Platform. You can download all your data and delete your account at any time from the app or the web dashboard.

When you post a ride on your profile or share a link, you understand that other people will see what that setting or link shows. Check your profile's visibility and revoke any links you no longer want to share.

6. Acceptable use

The following are not allowed: using the Platform for illegal activities; impersonating others; using the SOS or the alerts without a real need or to annoy people; harassing, threatening or discriminating against other users; publishing content that is unlawful, violent or infringes the rights of third parties; faking your location; extracting other users' data; or interfering with the security of the service. We may remove content and suspend or close accounts that breach these rules.

7. Paid services

At present, all features of the Platform are available free of charge. If paid plans are offered, their conditions (price, duration, renewal, cancellation and right of withdrawal) will be communicated in advance and these Terms will be updated before they come into force. Achievements and badges are virtual items with no monetary value; they cannot be exchanged or transferred.

8. Liability

Driving, cycling and outdoor activities involve risks. KURVO is a coordination, recording and alert tool: it does not guarantee your safety, the continuous accuracy of geolocation (which depends on the device, GPS and network coverage) or the delivery of alerts. To the extent permitted by law, the owner is not liable for damage arising from the way users drive or ride, from a guardian failing to respond or from use of the Platform contrary to these Terms. Nothing in these Terms limits the rights that consumers cannot waive.

9. Suspension and termination

We may suspend or close accounts that breach these Terms, letting you know unless the seriousness of the breach or the law prevents it. You can leave at any time by deleting your account; your data is deleted in accordance with the Privacy Policy.

10. Changes

Each version of these Terms has a date and a number. If we change them substantially, we will ask you to accept them again in the app before you continue using it, and we will give you reasonable notice whenever possible.

11. Governing law

These Terms are governed by Spanish law. Disputes will be submitted to the competent courts and tribunals in accordance with consumer protection legislation. Contact: contacto@kurvo.es.
